Ultimate Shred Academy – Terms and Conditions (2024–2025)

1. Introduction

These Terms and Conditions constitute a binding agreement between you (the "Learner") and Ultimate Shred Academy Ltd ("the Academy"), a registered training provider located at Unit 3, Royal Business Park, Kings Street, Pontefract WF8 4AH. By enrolling in any programme, course, or service offered by the Academy, you confirm that you have read, understood, and agreed to these terms.

These Terms apply to all learners, whether attending online or in-person delivery.

 

2. Eligibility and Enrolment

2.1 Learners must be aged 16 or over and possess the right to study in the United Kingdom.

2.2 Enrolment requires submission of accurate information, completion of the enrolment application, Individual Learning Plan (ILP), and where applicable, financial agreement forms.

2.3 Enrolment is subject to acceptance by the Academy and may be withdrawn at any stage due to non-compliance, non-payment, or breach of any stated terms.

 

3. Course Engagement and Attendance

3.1 Learners are expected to attend at least 90% of scheduled learning sessions and assessments unless previously approved under the Special Considerations Policy.

3.2 Punctuality is essential. Learners arriving more than 15 minutes late may be refused entry to the session and marked absent.

3.3 Persistent absenteeism or lateness may result in formal warnings, catch-up sessions, or removal from the programme.

3.4 Learners are required to engage with all elements of the course, including practical assessments, theory workbooks, professional discussions, case studies, and reviews.

3.5 Missed sessions must be caught up independently or at arranged times with the tutor. Additional sessions may incur an administration fee.

 

4. Health and Safety

4.1 Learners must complete a mandatory Health and Safety Induction before engaging in any physical training.

4.2 Learners must follow all Academy safety protocols, including fire safety, manual handling, accident reporting, and emergency procedures as outlined in the Health & Safety Policy.

4.3 Any hazards, faulty equipment, or injuries must be reported immediately to Academy staff.

4.4 Failure to follow safety instructions may result in disciplinary action or removal from gym premises.

 

5. Safeguarding, Prevent, and Wellbeing

5.1 The Academy operates a zero-tolerance approach to abuse, harassment, bullying, neglect, or radicalisation.

5.2 All safeguarding concerns must be reported to the Designated Safeguarding Lead (DSL) or Deputy DSL immediately.

5.3 Learners will be provided with guidance on how to report concerns during induction.

5.4 The Academy complies fully with the Prevent Duty, promoting British values and safeguarding against extremist influence.

 

6. Behaviour and Conduct

6.1 Learners must behave in a respectful and professional manner at all times.

6.2 Disruptive behaviour, inappropriate language, harassment, or discrimination of any kind will not be tolerated.

6.3 Serious misconduct may result in immediate suspension and permanent removal from the programme.

 

7. Equality, Diversity, and Inclusion (EDI)

7.1 The Academy is committed to ensuring equal opportunities for all learners regardless of age, gender, race, disability, religion, sexual orientation, or background.

7.2 Reasonable adjustments and accessible resources will be provided where appropriate to support learners with additional needs.

7.3 Discrimination, victimisation, or harassment must be reported and will be addressed in accordance with the EDI Policy.

 

8. Finance and Payment Terms

8.1 Course fees must be paid in full or under an approved payment plan prior to course commencement.

8.2 We accept direct bank transfers, Stripe instalments, and Payl8r finance (subject to approval).

8.3 Learners remain contractually liable for the full course fee once access to course materials has been granted.

8.4 Failure to meet agreed payments may result in restricted access, additional fees, removal from the course, and debt recovery procedures.

8.5 Refunds will only be considered where the learner has not accessed the course and makes a written request within 14 days of enrolment.

8.6 Refunds due to medical reasons will require supporting evidence and will be assessed case-by-case.

 

9. Certification and Assessment

9.1 Certificates are issued by NCFE and will only be processed upon full completion of all learning, internal verification, and confirmation of payment.

9.2 Ultimate Shred Academy aims to issue certificates within 30 days of course completion.

9.3 Learners are responsible for ensuring their name is correctly submitted for certification.

9.4 Assessments must be the learner’s own work. Any suspected plagiarism or malpractice will be investigated in line with the Malpractice Policy.

 

10. Complaints and Appeals

10.1 Learners are encouraged to resolve complaints informally with their tutor.

10.2 Formal complaints should be submitted in writing to the Course Operations Manager within 5 working days of the issue.

10.3 Appeals on assessment outcomes must follow the process outlined in the Complaints and Appeals Policy.

10.4 All complaints and appeals will be acknowledged, investigated, and responded to within specified timescales.

 

11. Data Protection and Confidentiality

11.1 Ultimate Shred Academy complies fully with the UK GDPR and Data Protection Act 2018.

11.2 All learner data will be processed lawfully, stored securely, and only shared with relevant awarding bodies or regulatory agencies where required.

11.3 Learners may request access to their data, ask for corrections, or request deletion in accordance with our Data Protection Policy.

 

12. Intellectual Property

12.1 All course content, materials, assessments, and resources provided by Ultimate Shred Academy remain the intellectual property of the Academy.

12.2 Learners may not reproduce, distribute, or share Academy content without express permission.

 

13. Contingency Planning and Centre Closure

13.1 In the event of temporary disruption (e.g. illness, fire, pandemic), the Academy will implement its Contingency and Adverse Effects Policy.

13.2 This may include online delivery, rescheduling of sessions, or deferral of assessments.

13.3 In the unlikely event of centre closure, learners will be supported in transferring to another recognised provider.

 

14. Governing Law

These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be handled in the jurisdiction of the English courts.
